Field Sobriety Tests
If a law enforcement officer suspects that you are driving under the influence of alcohol, then he or she will pull you over for a suspected DUI. When this happens, you should expect to be given either a breathalyzer test or a series of field sobriety tests. These examinations serve to provide a good estimate on your level of intoxication. If the officer does not have a breathalyzer machine on hand, then you should expect to be asked to complete several in-field, physical and cognitive exams.
There are two types of field sobriety tests: standardized and non-standardized. The standardized tests have been researched and approved by the US Department of Transportation, and they include the following:
- Walk-and-Turn: You will be asked to take 9 heel-to-toe steps one way, turn around, and come back without losing balance, falling over, failing to follow instructions, or show any other signs of intoxication.
- One Leg Stand: You will be asked to stand on one foot and count up, starting at one thousand, for thirty seconds. Any loss of balance, inability to count correctly, or swaying will serve as indicators that you are intoxicated.
- Horizontal Gaze Nystagmus: You will be asked to follow a penlight with your eyes as it passes back and forth in front of your face. Involuntary jerking and impairment of the eye will indicate that you are under the influence.
Aside from these standardized examinations, you may also be given other tests at the officer’s discretion. Unfortunately, many of these tests have questionable reliability.
