Probation

Probation is a type of sentence which can be issued by a court instead of jail time. Rather than putting someone in crowded prison, probation lets the court punish you while allowing you to continue being a contributing member of society. Although there are terms to follow and probation is far from being a walk in the park, it's far preferable to spending time in jail.

Probation is an option for misdemeanors and less serious felonies, which are called “probational offenses.” However, it is usually not available for more serious felonies, such as rape and murder. It is a less serious punishment than prison, and is most commonly served in lieu of it, either after a criminal has already served part of his or her prison sentence, or instead of the prison sentence entirely.

The terms of probation vary from case to case, especially depending on how serious the conviction was, and whether or not you have any prior convictions. Some of the most common terms are:

  • You must remain productively employed for the duration of your probationary sentence.
  • You must follow the instructions and orders of your probation officer.
  • You may have to follow a curfew, or live in a residence provided in the terms of your probation.
  • You may be required to not leave the jurisdiction.
  • You may be required to avoid contact with certain people related to the crime. For example, if you were convicted of abusing your girlfriend, you could be barred from seeing her during your sentence. Another common one is being prohibited from contacting other criminals, particularly any co-defendants.
  • In certain cases, you may be fitted with an electronic tag, which tracks your movement.
  • Drug and alcohol testing may be required.
  • Community service is frequently required.
