Your Fourth and Eighth Amendment Rights

Your fourth and eighth amendment rights under the Bill of Rights of the United States Constitution are meant to protect you during the criminal process.

The fourth amendment states:

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

The eighth amendment states:

Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.

This means that your bail must match the crime that you allegedly committed. Also, you cannot be punished in a cruel and unusual way. This protects you against things like torture, but it also means that your punishment must fit your crime.
