DWI Overview
When it comes to being pulled over and arrested for a DWI you have many rights. You have all of your Miranda Rights as well as the rights to refuse any field sobriety test they ask you to take. Be warned that if you refuse any of their tests, they will take you immediately to jail and revoke your license for up to 180 days. When they give you a breathalyzer, you will be breathing into a Intoxilyzer 5000. Although it may not be 100 % accurate, it will be vary hard to avoid it if your BAC is above the legal limit. Once you have taken the breathalyzer, there is no way to have it retested. Whatever you happen to blow the first time is what they say you had. Your BAC or Blood Alcohol Content cannot be above the legal limit of .08%. If you do take the breathalyzer and blow above a .08%, they will take you to jail and most likely revoke your license too. For people who drive a commercial vehicle the legal limit is .04% and for people under 21 there is a “zero tolerance”. This basically means that if you are under 21 and blow any type of number at all, they will arrest you and take you to jail immediately. After being arrested, you will have to have a hearing with the court to decide your bail, and they will, at that point, set another time for you to meet with the court to discuss your case with a judge.
