When Arrests Happen - Understand Bail
When you are arrested for a crime, you can expect the judge to either set a bail or deny you bail. Bail is usually a sum of money that is exchanged for the release of someone who has been arrested and is meant to guarantee that the arrested individual will appear for trial at a later time. If you are denied bail, you will not be able to leave jail until the date of your criminal trial.
The two most common ways for someone to be bailed out of jail are:
- Posting cash bail at the jail
- Contacting a licensed bail agent to post a bail bond
Posting Cash Bail
If the defendant or someone other than the defendant wishes to pay the full amount of their set bail, the defendant is released under the condition that they will return for trial. Once the defendant has appeared in court and the case is resolved, the cash that was posted for bail is then returned to whoever posted it.
Contacting a Licensed Bail Agent
In the event that the defendant, the defendant’s family, or the defendant’s friends do not have the ability to pay the full bail amount they can contact a licensed bail agent. When a bail agent posts a bail bond, they need to attain premium and collateral. Premium is 10% of the set bail. Collateral is usually cash, real estate, cars, or signatures that the bail agent holds onto until the defendant has completed all required trial appearances.
