If I’m suspected of driving under the influence, do I have to take a breathalyzer test or can I refuse?
You have the right to refuse to take a breathalyzer test; however, doing so results in an immediate thirty day suspension of your license and an additional one year suspension. Before the police officer begins the test, they must make you aware of your rights. If you have taken a breathalyzer test, contact an attorney to see if the results of the test can be contested. The machines that provide the breathalyzer test must be regulated and maintained and any improper administration of a test could result in the court dismissing your charge based on a faulty breathalyzer machine.
