What should I do if I’m arrested?
If you are arrested, it is your decision whether or not you’d like to answer the police officer’s questions. You have the right to remain silent since anything you say could be used against you in trial. You have the right to consult an attorney before signing any documents. If you do not have an attorney at the time of your arrest, you may ask to be given one immediately. Another option is to consult the Public Defender if you can not afford the fees of an attorney.
If you are being arrested, it is in your best interest to go peacefully. Fighting a police officer is a felony charge and violent actions towards a police officer may result in harsh treatment in return. Police officers have the right to use an appropriate amount of force to retain control. If you are violent during your arrest, the police may have to use considerably more force to get the situation under control.
